Renowned Warri  based lawyer and the All Progressives Congress (APC) Candidate for the Warri Constituency 1 Seat into the Delta State House of Assembly in 2015, Mr. Robinson Ariyo Esq on Tuesday stated that he will not contest for the seat if the national body of the party does not resolve the lingering constitutional crisis rocking the APC in Delta State.
Ariyo however was quick to state that he will only contest the election if the national headquarters of the APC put in place an “interim committee” to midwife the process in line with the Party’s Constitution as well as do away with those who are not members of the APC.
The legal practitioner made the assertion during a press conference in Warri, Delta State.
“If they leave it in the hands of those who are not members of the party, I may not contest the forthcoming by-election.”
Ariyo warned that the APC may be excluded from participation in the forthcoming Warri South Constituency 1 by-election due to the constitutional crisis in the party.
While noting that there are two factions of the APC in the State Executive Council with one illegally led by Chief Adolo Okotie-Eboh and the other led by Prophet Jones Erue, Ariyo pointed out there are about six factions of the party in Warri South Local Government Area alone.
Ariyo stated that Prophet Jones Erue and his cohorts are not members of the party.
Ariyo also accused some persons at the national headquarters of the APC of conspiring with the Prophet Jones Erue led Exco and instituting a suit against the APC with a view to excusing themselves that steps cannot be taken to enforce the a judgement against them.
Ariyo cited several sections of the APC thus ,”Any member who file an action in Court of law against the Party or any of its Officers on any matter or matters relating to the discharge of the duties of the party without first exhausting the avenues for redress provided for in this Constitution shall automatically stand expelled from the party on filing such action and no appeal against expulsion stipulated in this clause shall be entertained until the withdrawal of the action from court by members”.
Ariyo argued that by virtue of the APC Constitution, Prophet Jones Erue and his cohorts are no longer members of the party.
He also added that Prophet Jones Erue is no longer supposed to be in possession of any property including its register and nomination forms.
Ariyo also noted that the only option is for the Jones Exco to withdraw the suit  with Suit No; FHC/WR/CS/165/15 against 2 Others Vs APC which is pending before the Federal High Court and tender an
appeal to the Executive Committee of the Party before being considered by the National Executive.
The legal practitioner vowed that he will not allow illegalities in the APC saying, “I will not let out more the illegalities that have been done thus far to avoid equipping the culprits with the most potent arsenal at my disposal”.
