The Federal University of Technology (FUT), Minna hope of getting a new Vice Chancellor soon ysesterday suffered a setback as the High Court sitting in Minna dismissed their motion praying the court to dismiss the case for the reason that the Court is not competent to hear the case.
The Court also adjourned the hearing the motion for the suit to the 22nd of January, 2013.
Earlier, three Professors Professor Musa Galadima, Professor Adama and Professor M.A.T Suleiman took the university and the Governing Council to court challenging the selection process of the Vice Chancellor, alleging the governing council has employed double standard in the selection process.
The University Dons who made reference to two different advertisements made by the university towards the call for applications for the post of the VC of the university prayed the court to stop the selection process of the VC.
However, when the case was first heard in October this year, Counsel for the university and the Governing Council, Barrister Olajide Ayodele called for the dismissal of the case claiming that the Court lack the jurisdiction to try the case.
The defence Counsel said that only a Federal High Court has the jurisdiction over the case.
This motion was however opposed by Barrister Ibrahim Ishyaku, counsel to the plantiffs as he argued that the court is competent and should proceed to hear the case.
The defendants however got a shocker when Justice Aishat Lami Bwari stated that the state High Court is competent and has the jurisdiction to hear the case while she adjourned the hearing for motions for the case to 22nd January 2012.
According to her, “This court has the right to entertain such a suit and the prayer of the defendants is dismissed.”
This adjournment restrains the Governing Council from announcing any substantive Vice-Chancellor for the institution.
To this end, the appointment of the VC of the university may not be visible until late January 2012 after the hearing of the case.
The acceptance of the state High Court to hear the case has added a stint of victory for the three University Dons.
